Privacy Policy

1. Overview

MeritHyre (“we,” “us,” or “our”) provides an AI-enabled interview and screening platform (the “Services”). This Policy explains how we handle personal information.

Anyone who registers to use the Services holds an account (an “Organization”). An Organization may add users to its account and set what each of them can access. Individuals an Organization invites to interview (“Candidates”) do not hold an account and take part only through an interview link or message thread the Organization initiates.

For Candidate information, we act as a service provider to the Organization and process it on the Organization’s instructions. The Organization is responsible for obtaining any consents and giving any notices required by law before submitting Candidate information or messaging a Candidate through the Services.

The Services are offered only in the United States. If you do not agree with this Policy, do not register for an account or use the Services.

2. Information We Collect

We collect this information directly from Organization users, from Organizations about the Candidates they invite, from Candidates during an interview, and automatically from the devices used to access the Services. Some of it — including interview questions, scoring criteria, transcripts, summaries, scores, and evaluations — is generated by the Services and can be reviewed or edited by the Organization.

We do not use facial recognition, voiceprint matching, or any other biometric identification technique.

3. How We Use Information

To deliver and support the Services, including scheduling and conducting interviews and generating transcripts, scores, and evaluations; to manage accounts and billing; to secure the platform and prevent fraud; to improve reliability using de-identified or aggregated data; to meet legal obligations; and, where an Organization user has opted in, to send product updates. We never use Candidate contact details for marketing.

4. AI Processing

We use third-party AI providers for language processing, voice, and transcription. We access them through their commercial APIs, whose terms provide that content submitted through the API is not used to train the provider’s models, and we have not opted in to any program that would allow this.

We do not use Interview Data to train or fine-tune AI models.

5. Google Sign-In

Where you sign in with Google, we receive basic profile information — name, email address, profile picture, and account identifier — and use it only to create and authenticate your account. We request non-sensitive scopes only.

Our use and transfer of information received from Google APIs adheres to the Google API Services User Data Policy, including its Limited Use requirements. We do not use data obtained through Google APIs, in raw, aggregated, anonymized, or derived form, to develop, improve, or train generalized or non-personalized AI or machine learning models, and we do not sell it or use it for advertising.

You can revoke access at myaccount.google.com/permissions.

6. Text Messaging

We deliver SMS messages on behalf of Organizations relating to a specific job application: interview invitations, scheduling and reminders, application status updates, interview questions delivered by text, and Candidate responses during an interview conducted by SMS. We do not send marketing messages.

Candidates give their mobile number and consent to the Organization that invites them.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing with subcontractors in support services, such as message delivery and customer support, is permitted. All other categories described in Section 7 exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

Message frequency varies. Message and data rates may apply. Reply STOP to opt out, or HELP for help. Carriers are not liable for delayed or undelivered messages.

Consent to receive text messages is not required to apply for a role or take part in an interview.

7. Sharing

We do not sell personal information or share it for cross-context behavioral advertising. We share information with:

  • Service providers for hosting, message delivery, AI processing, analytics, and payments, engaged under terms that permit them to use it only to provide their service to us.
  • The Organization that invited a Candidate, which receives that Candidate’s Interview Data and evaluations. Within that Organization, the information is available to the users it has authorized.
  • Systems an Organization connects to the Services, as that Organization directs.
  • Authorities or others where required by law, or to enforce our Terms of Service or protect rights, property, and safety.
  • A successor entity in a merger, acquisition, or sale of assets.

8. Retention

We keep personal information for as long as reasonably necessary for the purposes described in this Policy, then delete or anonymize it. How long that is depends on the type of information, the purpose it serves, and any legal, tax, or audit requirement that applies.

Interview Data is kept for as long as reasonably necessary to provide the Services to the Organization that collected it. Information in backups is removed on our normal backup cycle after deletion from active systems.

We act on verified deletion requests within the timeframe required by applicable law, except where we are required to retain information longer.

9. Security

Information is stored and processed in United States data centers. We use industry-standard safeguards including encryption in transit and at rest and role-based access controls. No system can guarantee absolute security.

10. Your Rights

Where a U.S. state privacy law applies to you, you may request access to the personal information we hold about you, correction, deletion, or a portable copy, and you will not be treated differently for making a request. Because we do not sell or share personal information for advertising, no opt-out applies.

Email privacy@merithyre.ai. We verify identity before responding. An authorized agent may submit a request with proof of authorization. If a request concerns information an Organization submitted about you as a Candidate, we will pass it to that Organization and assist as needed.

Organization users can manage marketing preferences in account settings or by unsubscribing. Essential service notifications continue while an account is active.

11. Age

Accounts are restricted to individuals aged 18 or over. We do not verify a Candidate’s age; where a Candidate is a minor under applicable law, the Organization is responsible for any consent required. We do not knowingly collect information from children under 13, and will delete it if we learn we have.

12. Changes

We may update this Policy and will update the “Last Updated” date above. We review it at least once every 12 months. For material changes, we will email Organization administrators and post notice on our website before the change takes effect.
